Awnitboss Referral Program Terms
These Referral Program Terms add to the Awnitboss CRM - Real Estate Terms of Service, which governs your use of Awnitboss generally. Where the two conflict on the referral program described below, these Referral Program Terms control.
Awnitboss Referral Program (agent to agent).
(a) What it is. Awnitboss may offer a referral program for Awnitboss CRM - Real Estate. You can share your personal referral link or referral code with other real estate professionals. Referral credit is a discount on your Awnitboss software bill only. It is never a payment for referring real estate clients, leads or transactions, and no credit depends on any real estate transaction. Awnitboss never sends referral messages on your behalf.
(b) How you earn credit. When an agent who signed up through your link, or entered your referral code at checkout, pays for an Awnitboss plan, you earn credit equal to the percentage of each of their plan payments shown on the referral card in Settings. You earn it for the period shown on the card, counted from their first plan payment, or, when the card says so, for as long as you both stay subscribed. A plan payment counts after its discounts and before tax, and never for more than they actually paid; add-ons and taxes do not count. A yearly payment counts as twelve monthly amounts, earned one month at a time. If the card shows a first-month discount for the referred agent, it applies to the first invoice of their first-ever paid Awnitboss subscription; on a yearly plan it equals that percentage of the plan's monthly price, taken off once. It does not combine with another discount code: the larger discount applies, and a special plan's code always replaces it.
(c) Who qualifies. Each new paying customer counts once, for one referrer, and only if their first Awnitboss plan payment is made while the program is on. No credit or discount is given:
- for referring yourself, including another account that shares your sign-in email address (in any form of it), verified phone number, verified license, payment card or billing account;
- for a person or payment card that has already been part of an earlier referral, through anyone's link or code;
- for someone who has already paid Awnitboss on another account;
- for accounts that refer each other, or for duplicate, fake or banned accounts;
- for any month in which you do not have an active, paid Awnitboss plan in good standing on the day that month's credit is earned. That month's credit is cancelled, not saved for later. While a payment of yours is past due, credit waits for up to 30 days and is cancelled if the payment is still unpaid then. Credit also waits until you agree to the current version of these Terms, for up to 12 months after the date it would otherwise have been earned; after that it is cancelled.
(d) Using credit. Earned credit is applied automatically to your next Awnitboss plan renewal invoice, shortly before that invoice is issued. It lowers only the price of your plan, after any other discount and before tax, down to $0 and never below. Credit beyond your plan's price on that invoice is not carried forward. Referral credit has no cash value and cannot be refunded, withdrawn, sold or transferred to another account. It is not paid out if you cancel or downgrade. Credit not yet applied is cancelled if your plan ends, is paused, or stops being paid (other than while a payment is past due).
(e) Limits. There is no limit on how many agents you can refer. Your credit can lower your plan's price to $0 on any invoice, never below.
(f) Reversals and fraud. If a referred agent cancels or stops paying, you keep the credit from payments they already made, and no more is earned from them. If a payment that earned credit is refunded in whole or in part, disputed, charged back or reported as fraud, the credit from that payment that has not been applied is cancelled (in proportion, for a partial refund), and credit from it that was already applied is deducted from your later referral credit. If a referred account received the first-month discount but used your payment card or billing account, or a payment card already used in an earlier referral, Awnitboss may add the discount back to the next invoice of that subscription (checkout says so when the discount is applied). Awnitboss may withhold, cancel or remove referral credit obtained through fraud, a refund, a chargeback, abuse or a breach of these Terms, and may suspend your referral privileges. To prevent fraud, Awnitboss compares accounts' sign-in email addresses, verified phone numbers and verified licenses (kept for this purpose only as one-way hashes) and the payment-card fingerprint our payment processor provides, and keeps a record of each credit decision.
(g) Changes. Awnitboss may change or end the program with notice on the referral card or by email. A change to the credit percentage or period applies to payments made after the change. If the program ends, credit already earned is still applied as described above; credit not yet earned, such as the later months of a yearly payment, is not.
(h) Sharing your link or code. You are responsible for how you share your link and code. When you share them or recommend Awnitboss, say that you get credit on your Awnitboss bill if the person joins. The message the referral card copies already says this. Share your link and code one to one with people you know. Do not send them in bulk email or text blasts, or in anything that looks like it comes from Awnitboss.
(i) What each side sees. While the program is on, your referral card shows how many of your referrals are active and the credit they have earned you. When credit from a referral stops, because its period ended or the referred agent is no longer on a paid plan, Awnitboss tells you by email without naming the agent. If you joined through someone's link or code, that agent can see that you signed up, whether your referral is active and the credit it earns them, and is told when that credit stops.
